The US Supreme Court has authorized the Trump administration to implement its ban on transgender individuals serving in the military, overturning a lower court's injunction and permitting the policy to take effect amid ongoing legal disputes.

In a 6–3 decision issued on May 6, 2025, the Court reinstated President Donald Trump’s executive order titled “Prioritizing Military Excellence and Readiness.” This order, enacted a week after Trump resumed office in January, prohibits transgender individuals from enlisting and mandates the Defense Department to identify and discharge any service members diagnosed with, or showing symptoms consistent with, gender dysphoria.

The Supreme Court's ruling nullifies a nationwide injunction that had been placed by a federal judge in Washington state in March.

Under the reinstated policy, individuals with a diagnosis of gender dysphoria are barred from military service unless they serve in their biological sex and refrain from pursuing gender transition. The Department of Defense has been instructed to put this policy into action, which includes discontinuing gender-affirming medical care for transgender service members.

Trump initially enacted a ban on transgender individuals serving in the US military in 2017. Former President Joe Biden lifted the ban shortly after taking office in 2021, only for Trump to reintroduce it during his second term.

Since returning to office, Trump has revoked numerous executive orders issued by his predecessor, including many aimed at supporting racial minorities and the LGBTQ community. Additionally, he issued a formal directive acknowledging only two genders—male and female—which, per the order, cannot be altered. Trump also terminated federal funding for what he referred to as the “chemical and surgical mutilation” of children through the use of puberty blockers, hormones, and other medical procedures related to sex changes for individuals under 19.
